These terms

These Terms of Use govern the public website at zachnaon.com and its free resources. The website is operated by Zach Naon under the Painpoint name.

A purchase of the AI Tools Assessment is also governed by the Assessment Terms. A separate signed agreement governs Concierge or other client services. If a signed agreement conflicts with these website terms, the signed agreement controls for that engagement.

Website use

You may use the website for lawful informational and business purposes. You may not interfere with the site, attempt unauthorized access, submit malicious material, misrepresent your identity, scrape the site in a way that disrupts service, or use the site or its content to violate applicable law or another person’s rights.

Free prompts and resources

Public prompts, checklists, articles, and other free resources are provided for general information. They are not legal, financial, accounting, employment, cybersecurity, or other regulated professional advice.

You may copy, adapt, and use the public prompt templates inside your own business. You may not sell them as your own, remove ownership notices from substantial copied material, or republish them as a competing prompt library or content collection without written permission.

AI output can be incomplete, outdated, or wrong. You are responsible for reviewing facts, calculations, commitments, customer communications, and actions before relying on or using any output.

Forms, bookings, and services

Submitting a form, sending a message, or booking a call does not by itself create a client relationship, guarantee acceptance of an engagement, or authorize Zach Naon to act for you.

Prices, deliverables, guarantees, refunds, recording consent, and purchase conditions for the AI Tools Assessment are described at checkout and in the Assessment Terms. Other paid work requires a separate written scope or services agreement.

Intellectual property

The Painpoint name, Zach Naon branding, original website copy, designs, assessment materials, and proprietary service methods belong to Zach Naon or their applicable licensors. No ownership transfers merely because content is viewed, downloaded, or used.

Third-party names, products, and trademarks belong to their respective owners. References do not imply endorsement unless expressly stated.

Third-party services

The website links to or relies on services such as Stripe, Jotform, Calendly, Cloudflare, Google, Fathom, and Notion. Those services operate under their own terms and policies. Zach Naon is not responsible for third-party outages, changes, or content outside his control.

Availability and disclaimers

The public website and free resources are provided “as is” and “as available.” While reasonable care is taken, Zach Naon does not promise that the site will always be available or that public information and AI-generated results will be complete, current, or suitable for every business.

To the extent permitted by law, Zach Naon disclaims implied warranties related solely to use of the public website and free resources.

Limitation of liability

To the extent permitted by law, Zach Naon will not be liable for indirect, incidental, special, consequential, or lost-profit damages arising solely from use of the public website or free resources. Nothing in these terms limits liability that cannot legally be limited.

Governing law and changes

These terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. If one provision is unenforceable, the remaining provisions continue to apply.

These terms may be updated as the website or services change. The effective date above identifies the current version. Continued use after an update means the current terms apply to future use.
